Dispute Resolution

There are occasions where parties to a construction contract find themselves in a dispute that they are unable to resolve themselves.

In this instance, we actively encourage the use of Mediation and Adjudication, for those instances where Mediation is not effective or appropriate.

Our Director is a member of the Chartered Institute of Arbitrators through the Adjudication pathway and has completed a Master’s degree in Construction Law & Dispute resolution.  We can offer the following services:

Mediation

​

Mediation provides a neutral and non-judgemental approach to reviewing both parties position through a facilitated meeting and actively encouraging an agreement to be reached with the consent of both parties.  This has proven to be a very effective way of resolving disputes that is usually very quick (often just 1 day) and provides a low-cost solution, often parties can regain or even enhance their relationships following a successful mediation agreement.

Our Director can provide support for preparation and non-legal represenation at Mediation, providing a very pragmatic and effective role in reaching an agreement.

Adjudication Commencement & Support

 

If you are in a situation where you are considering serving a notice of adjudication or believe that you are at risk of receiving a notice, our Director can provide a comprehensive review and provide advice on next steps.

Following the review, our Director can also assist you in the preparation of documents that will be required for an adjudication, serving of the notice of adjudication, appointment of adjudicator, referral notice and ongoing support during the adjudication process.
